Predict-it™ (“Predict-it,” ”we,” “us,” or “our”) is committed to protecting your personal information as if it were our own. Our de facto rule regarding your privacy is to gather the minimum personal information needed to provide our services effectively. We respect your right to privacy through Anonymous Personalization™ and we hold all personal information you choose to provide in the strictest confidence. We do not distribute, sell, rent, or share your personal information except in the limited circumstances described in this document, which explains our practices regarding the collection, use, and disclosure of your personal information.

Personal information specifically identifies an individual and comprises of a name, address, telephone number, e-mail address, or other account number, and may further include demographic information such as date of birth, gender, and geographic area. Personal preferences may also be included whenever such information is linked to other data that identifies an individual. Personal information also includes details about an individual's online activities, such as web site usage.
4. How We Define Aggregate Information
Aggregate information indicates the data that we collect about a group or category of products, services, or customers, from which individual identities have been removed. For example, information about how a group of our customers use our service may be collected and combined to determine how similar groups would use the same service.
5. Use of Our Web Site by Children
Predict-it is NOT targeted towards, or intended for use by anyone under the age of 18. By using our web site you represent and warrant that you are 18 years of age or older. We reserve the right to terminate a membership in the event that we learn a member is under 18 years old. Persons under 18 may not submit any personally identifiable information to us, and if we discover that we have inadvertently gathered such information, we will take the appropriate steps to remove it from our system.
6. Use of Personal Information
Predict-it uses the personal information that we gather to provide the best possible match between customers and suppliers, and upon our customers’ request, we also provide updates and offers from Predict-it and our suppliers. We utilize all available technologies to evaluate the use and performance of our services by our customers and may publicize aggregate information such as total number of members and suppliers.
Predict-it customers will be able to choose whether or not they want to receive specific communications that Predict-it offers to its members. These communications include, but are not limited to updates and newsletters about new features, special offers, and targeted promotional items available from Predict-it or suppliers.
Communications are primarily sent via e-mail, instant messaging, and postal mailings; however, we may also use additional communication methods such as telephone, text messaging, and fax. Each communication will clearly explain how to opt out of future communications.
7. Control of Personal Information
Active members can view, edit, and delete personal information from password-protected profile pages. Some personal information we gather will not be accessible for viewing, editing, or deleting, such as information gathered automatically.
If a membership is deactivated for any reason, access to the password-protected profile pages will be lost along with the ability to change or delete the information contained therein. When a member’s account becomes inactive, personal or professional contact information, such as name, postal address, phone number, e-mail address, and credit card data, can be removed from our system by issuing a request with Predict-it’s Customer Services. Requests to remove contact information will be subject to member identification verification and complete removal can take up to 72 business hours. Upon request, the inactive member will receive an e-mail confirmation when the information removal is complete. If an account is canceled, terminated, or suspended, some data may be retained in our system in order to prevent re-registration.
8. Collection of Information
The use of certain features on our web site requires that users register and supply personal information. We use this information, as well as other information in our databases, to provide personalized services, to customize the user experience, analyze web site and user behavior, troubleshoot technical problems, resolve disputes, address complaints, and prepare aggregated reports that we share with others.
We collect your personal information in a number of ways.
A) Information provided by users and members:

· When suppliers are added or rated, or when reviews are posted
· When contacting us in any way or for any reason

o Search terms
o Entry and exit points through which our web site is accessed
o Internal page addresses that have been visited, as well as page views
· Additionally, we may use clear GIFs to let us know if an e-mail we’ve sent has been opened. Clear GIFs are tiny graphics with a unique identifier and are similar in function to cookies.
C) Other data we collect
We may collect data from or about our members in ways not specifically described in this statement. For example, a member might respond to a postal marketing mailer, contact customer support, or we may receive a third party complaint about one of our members. Such information may be logged and tracked in our databases or other information systems.
9. Cookies, Clickstream, and Clear GIFs
Most browsers and e-mail programs automatically accept web application trackers such as cookies, clickstream, and clear GIFs monitoring as the default setting. You can modify the settings on your computer to reject these trackers by editing browser and e-mail options. If you decide not to accept them, you will still be able to access those parts of our site available to the general public, but you may not be able to use some of our features or services, and you may have a less satisfactory experience.
10. Disclosure of Information
We may share personal information with third party vendors, other companies, and agents or contractors who assist us in performing functions necessary to operate our business, without limitation. Some examples of such functions may include web site hosting, data entry, and credit card processing. We limit the information shared with such entities to what we believe is necessary in order for them to carry out their functions. Moreover, we require that they agree in writing to comply with our privacy practices, and they may not use the information for other purposes except as required by law. We are not responsible for any failure on their part to comply with our privacy practices, nor are we responsible for any additional information that our members provide directly to outside parties.
11. Legal Disclosures
We may disclose personal information in the good faith belief that we are lawfully authorized or required to do so, or if doing so is reasonably necessary to comply with any legal process or authority. Such disclosure may occur as we respond to any claims or protect the rights, property, or personal safety of Predict-it, our users, employees, or the public. Information about our users, including personal information, may be disclosed or transferred as part of, or during negotiations of, any merger or sale of Predict-it assets or acquisition.
We take the protection of our members’ information seriously and have implemented significant security measures in an effort to safeguard personal information while it is under our control. When sending sensitive information across the Internet – including login ID, passwords, and purchasing information, such as credit cards – we use Secure Socket Layer (SSL) encryption. Information we gather is stored on password-protected secure databases, which are situated behind security firewalls. Access to the system by employees, vendors, agents, and contractors is limited to the functionality necessary for each individual’s job or role within the company. Employees, vendors, agents, and contractors are informed of our security policies and are bound by a signed confidentiality agreement prior to gaining access to applications and data on our network.
Unfortunately, no security system is 100% infallible, and therefore we cannot guarantee the security of our members’ information or assume liability for improper access to it. By providing Predict-it with personal information through any means, all users and members agree not to hold us liable for any unauthorized access to personal information or dissemination of that information, and further agree that we may engage in electronic communications regarding security, privacy, and administrative issues relating to the use of our services.
13. Your Passwords
Your account information is accessible online only through the use of a password. You should never disclose your password to any third parties. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. You are responsible for all uses of our web site by any person using your password. Therefore, if your password has been compromised in any way, you should change it immediately. Although you will need to use your password to sign on to your account, Predict-it will never ask you to disclose your password to us. Please advise us immediately if you believe your password has been misused.
14. Publishing Content and Ratings
Members can publish content, such as ratings, comments, and reviews of suppliers, supplier services, and supplier products. The content that our members publish may be displayed publicly and will be associated with the publishing members’ nickname. Members can choose whether to allow suppliers to respond to published content.
Active members may able to create a friends network with other members, including both suppliers and customers, who in turn may choose to receive e-mail notifications of content publications. Additionally, members may choose to receive specific communications from suppliers. Such communications may include direct responses to a member’s ratings, reviews, comments, and special promotional offers.
As described in our Terms of Service, Predict-it and suppliers may republish our members’ published content. Among other things, the content that members publish will be used to personalize our web site, identify and highlight member activity, and measure match quality between members and suppliers.
15. Published Content on Our Web Site
All information published on our web site is considered private and intended for the exclusive use of our members. Users may not harvest any data (including business names, contact names, phone numbers, or e-mail addresses) from our web site, and specifically may not use information displayed on the site to solicit our members or suppliers to join, contribute, or purchase services and/or products unless doing so is explicitly allowed within the approved guidelines in our Predict-it Terms of Service Agreement.
16. Communicating by E-mail with Suppliers and Other Members
Personal e-mail addresses, as well as business e-mail addresses, are not visible in any e-mails or communications that are sent through our site unless provided within the body of the message by the author of the communication.

19. Policy Changes
We reserve the right to change our privacy and terms of service policies as we update and expand our services. With the exception of extraordinary circumstances, we will make reasonable efforts to notify our members at least 30 days in advance of our intent to make changes to our policies. We will post updated policies and terms on our web site and always include the date that any such documents were last updated. Members who don’t agree to the updated policy changes can choose to discontinue their membership under our standard membership cancellation terms as outlined in the Terms of Service Agreement.

20. Third Party Advertising
The suppliers listed on our site have the ability to publish advertisements along with information to highlight their business offerings. Our members will be able to opt in or opt out from receiving information from the suppliers they visit.
21. Payment Information
To simplify membership renewals, orders, and purchases, we request your credit card number, its expiration date, and your billing and shipping addresses. This information is transferred safely over the Internet using Secure Socket Layer (SSL) encryption provided by VeriSign. Your personal purchasing information is then stored on a secure server. This information is only used to bill you for products and services you purchase from Predict-it or for products or services you authorize Predict-it to purchase on your behalf.
22. Special Offers
Predict-it will provide special offers from time to time as will the suppliers listed on our web site. We will take reasonable steps to ensure that special offers clearly state an expiration date along with any rules that apply to the offer. Unfortunately, there is always the possibility that a typo, error, or some other extraordinary circumstance can affect an offer or coupon and therefore deem it unacceptable. Although we expect this to be a rare occurrence, we do reserve and support suppliers’ rights to reject special offers and coupons that are outside the scope of specials or discounts they are offering and/or that are the result of any kind of error or misrepresentation.
23. Our Strict Anti-Spam Policy
Predict-it despises unsolicited commercial e-mail or spam. We do not send e-mails to anyone without permission and we do not sell or provide e-mail addresses to any unauthorized third parties. Any newsletters, updates, or special offers that our members receive from us or our suppliers are those that members have specifically opted to receive. Each of the e-mails sent to our members includes an option to opt out of further communications, which can be utilized at any time.
Our members may use our e-mail system to invite family, friends, acquaintances, and business contacts to join our services, but members are not allowed to use our system to send out unsolicited bulk e-mail.

24. Business Owners
A business owner or representative may sign up as a member and then list and rate their own business. There is no need to be concerned about false ratings by business representatives because our patented Consumer-to-Business Matchmaking system carefully evaluates profile and taste comparisons between customers and businesses prior to accounting for the probability of satisfaction rating that is provided.
Suppliers get a lot of FREE functionality from our web site, which emphasizes their qualities and attracts the most compatible Predict-it members. Suppliers understand the value of high quality referrals and compete with each other to provide Predict-it members with better products, services, and pricing.
